These terms are an agreement between you and Ramped Development LTD, trading as Chute5 (“we”, “us”) about your use of the Avocado app. By creating an account or using the app, you agree to them. Please also read our privacy policy.
1. What Avocado is
Avocado is a budgeting app. You log your spending (by hand, with Siri, or through an optional Apple Pay shortcut) and track it against budgets, trackers and events.
Avocado is not a bank, a payment service or a financial adviser. It doesn’t hold or move money, and it doesn’t connect to your bank account. The figures it shows come from what you log.
2. Not financial advice
Nothing in Avocado is financial, investment, tax or legal advice. Budgets, totals and suggestions are there to help you keep track; decisions about your money are yours. Check important figures against your bank or card statements, which are the record of what you actually spent.
3. Your account
- You need an account to use Avocado. You can sign in with Apple, with Google, or with an email address you can receive codes at. Keep the account you sign in with, and your iPhone, secure.
- An account is for one person. You’re responsible for what happens in your account.
- You must be 18 or over to use Avocado.
- You can delete your account at any time in the app (Account, then Delete account). Deleting it deletes your data, as our privacy policy explains, and can’t be undone.
4. Your Avocado subscription
You need an active Avocado subscription to use the app, after any free trial.
- Plans and prices: Avocado is offered monthly (Avocado Monthly) and yearly (Avocado Yearly). The price for your region is shown in the app and on the App Store before you buy.
- Billing is by Apple. You buy through your Apple Account, and Apple takes the payment. Apple’s Media Services Terms also apply to your purchase.
- It renews automatically at the end of each period, at the then-current price, until you cancel.
- Cancelling: in Settings, tap your name, then Subscriptions, then Avocado, then Cancel Subscription. Cancel at least 24 hours before the renewal date to avoid being charged for the next period. When you cancel, you keep access until the end of the period you’ve paid for.
- Free trial: new subscribers may be offered a free trial. The subscription screen shows it, how long it lasts and the day your plan starts, only if you’re eligible. Unless you cancel at least 24 hours before the trial ends, your subscription starts and you’re charged at the end of the trial.
- Price changes: if the price changes, Apple tells you in advance, and asks for your agreement where the law or Apple’s rules require it.
- Refunds are handled by Apple, under Apple’s policies. We can’t issue refunds ourselves. You can ask for one at reportaproblem.apple.com.
- Offer codes: we may give out codes for free or discounted time, which you redeem through the subscription screen’s Redeem code or the App Store.
- A free week for feedback: while your free trial is running, from its fifth day, the app may offer you another free week for answering a short feedback form. It’s one week per account and per subscription, only during a free trial, and Apple applies it as a promotional offer, so your first payment comes a week later. It’s never linked to rating or reviewing the app.
- Restoring: if you reinstall or use a new iPhone, tap Restore on the subscription screen. A subscription belongs to the Avocado account that last restored it.
- If your subscription ends, your data stays in your account, and the Apple Pay shortcut keeps logging your payments, but you’ll need to subscribe again to open the app.
- Deleting your account doesn’t cancel your subscription. Cancel it with Apple first.
5. The Apple Pay shortcut and Siri
These are optional, and they rely on Apple’s Shortcuts, Wallet and Siri, which we don’t control.
- The shortcut may not run for every payment, for example if its automation is off, if another Wallet automation runs instead, or if Apple changes how Shortcuts works.
- Some payments arrive without an amount (for example, some transport payments). Avocado saves them marked “No amount” for you to complete.
- A payment in another currency is converted using mid-market exchange rates and marked “~”, because it’s an estimate. Your card provider’s rate and fees may differ.
- Siri can mishear a place or an amount. Check what it logged.
6. Using Avocado properly
You agree not to:
- use Avocado for anything unlawful;
- try to access other people’s accounts or data, or our systems beyond what the app gives you;
- interfere with, overload or disrupt the service, or use automated means to access it other than the features we provide;
- copy, modify, reverse engineer or resell the app, except where the law allows;
- abuse offers, trials or codes (for example, creating accounts to claim them repeatedly).
We may suspend or close an account that breaks these terms. Where it’s reasonable, we’ll tell you first and give you the chance to put it right.
7. Your content
What you put into Avocado is yours. You give us permission to store and process it only to provide the app to you, as our privacy policy describes.
8. Our app
Avocado, its design and its content belong to us or our licensors. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, as allowed by Apple’s Usage Rules, while these terms apply.
9. Changes and availability
We keep improving Avocado, so features may change. We aim to keep it available, but we can’t promise it will always be available or free of errors. Some things need a connection: spends you log offline are saved and sync when you’re back online, but other changes need you to be online.
If we change these terms in a way that matters, we’ll tell you in the app or by email before the change applies. If you don’t agree, you can cancel your subscription and delete your account.
10. Our responsibility to you
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit. Your statutory rights as a consumer are not affected.
- We’re responsible for loss you suffer that’s a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We’re not responsible for loss that wasn’t foreseeable, for business losses (Avocado is for personal use), or for decisions you make based on figures in the app.
- Otherwise, our total liability to you is limited to the amount you paid for Avocado in the 12 months before the claim.
11. Apple
These terms are between you and us, not Apple. In particular:
- Apple has no responsibility for Avocado or its content.
- Your licence to use Avocado is limited to Apple-branded devices you own or control, as Apple’s Usage Rules allow (including Family Sharing where it applies).
- We, not Apple, are responsible for maintenance and support. Apple has no obligation to provide any.
- We, not Apple, are responsible for any warranties the law gives you. If Avocado fails to meet one, you can tell Apple, and Apple may refund the price you paid for it. Apple has no other warranty obligation.
- We, not Apple, are responsible for any claims about Avocado, including product liability, failing to meet a legal or regulatory requirement, and consumer protection or privacy claims.
- We, not Apple, are responsible for investigating and dealing with any claim that Avocado infringes someone’s intellectual property.
- You confirm you’re not in a country under a US Government embargo or designated as a “terrorist supporting” country, and you’re not on a US Government list of prohibited or restricted parties.
- Our name, address and contact details are below.
- You must follow any third-party terms that apply when you use Avocado (for example, your mobile network’s).
- Apple and its subsidiaries are third-party beneficiaries of these terms, and can enforce them against you.
12. Law and disputes
These terms are governed by the laws of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
